You agree to indemnify, defend and hold harmless Yesterday Restored, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

SECTION 26 - AI-ASSISTED RESTORATION DISCLAIMER
Yesterday Restored provides AI-assisted photo restoration, enhancement, and colorization services. By purchasing our services, you understand that restoration and colorization may involve artistic and technological interpretation.
Colorized images are artistically estimated and may not exactly match the original colors, clothing, surroundings, objects, skin tones, vehicles, flowers, buildings, or historical details.
AI-assisted restoration may also estimate missing, damaged, faded, blurry, or unclear areas of an image. Exact reconstruction, exact likeness, exact facial details, exact historical accuracy, and perfect restoration are not guaranteed.
SECTION 27 - PHOTO QUALITY LIMITATIONS
The quality of the final restoration depends heavily on the quality of the original photo submitted.
We may be able to improve many faded, scratched, creased, yellowed, discolored, black-and-white, sepia, and older color photographs. However, very blurry, tiny, low-resolution, dark, overexposed, out-of-focus, or severely damaged photos may have limited restoration potential.
If facial features or important details are not clearly visible in the original image, AI-assisted restoration may estimate or recreate missing details, which can change how a person or object appears. We cannot guarantee that a restored image will perfectly resemble the person as remembered by the customer or family members.
SECTION 28 - CUSTOMER RIGHTS TO UPLOAD PHOTOS
By uploading a photo, you represent and warrant that you own the photo or have all necessary rights, permissions, and authority to submit the photo for restoration, enhancement, and colorization.
You agree that your uploaded photo does not violate any copyright, privacy right, publicity right, intellectual property right, or other legal right of another person or entity.
You agree to indemnify and hold Yesterday Restored harmless from any claims, damages, or expenses arising from your upload, submission, or use of any photo or content you provide.
SECTION 29 - CUSTOM DIGITAL PRODUCT / NO PHYSICAL PRINTS
Yesterday Restored provides custom digital photo restoration services. Unless clearly stated otherwise, no physical prints, frames, albums, or mailed products are included.
Completed restorations are delivered as digital image files by email or digital download.
SECTION 30 - REFUND AND CANCELLATION TERMS
Because each order is custom-created using the photo or photos submitted by the customer, orders cannot be canceled or refunded once work has begun.
Refunds are not provided because a customer dislikes an artistic interpretation, preferred a different color, expected a different result, submitted a low-quality or blurry photo, or expected exact historical accuracy or exact likeness where the original image did not contain enough detail.
If there is a technical issue with a delivered file, such as a corrupted file or delivery problem, please contact us at support@yesterdayrestored.com and we will review the issue.
SECTION 31 - REVISIONS / CHANGES
Restoration results are based on the uploaded image and any notes provided at the time of order. We may review minor technical issues at our discretion, but revisions are not guaranteed.
We do not guarantee changes based on details that were not visible in the original photo or not provided with the order, including exact clothing colors, eye colors, flower colors, vehicle colors, background details, or other historical details.
If you know specific color details, please include them when uploading your photo.
SECTION 32 - TURNAROUND TIME
Estimated turnaround times are provided for convenience and are not guaranteed. Most orders are completed within the timeframe listed on our website, but larger orders, high order volume, technical issues, poor image quality, or other circumstances may require additional time.
SECTION 33 - REFUSAL OF ORDERS
We reserve the right to refuse, cancel, or decline any order at our discretion, including orders involving unlawful, explicit, abusive, hateful, harassing, exploitative, misleading, or otherwise inappropriate content.
We may also refuse orders that we believe cannot reasonably be restored due to image quality, file issues, or other limitations.
SECTION 34 - PERMISSION TO PROCESS UPLOADED PHOTOS
By uploading photos or other materials, you grant Yesterday Restored a limited license to use, copy, process, modify, restore, enhance, colorize, store, and transmit those materials solely as needed to provide the services you purchased, deliver completed files, provide customer support, and operate our business.
This license does not give us ownership of your uploaded photos.
SECTION 35 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, Yesterday Restored shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including emotional distress, lost profits, loss of data, loss of sentimental value, or dissatisfaction with artistic or AI-assisted restoration results.
To the fullest extent permitted by law, our total liability for any claim related to an order shall not exceed the amount paid by the customer for that specific order.
